class='avia_textblock'  itemprop=\"text\" ><h1>Soon is now<\/h1>\n<p>The legal stuff we started talking about back in <a href=\"https:\/\/www.nettl.com\/us\/soon\/\">October 2017<\/a> comes into force on the 25th May. It\u2019s called GDPR. You may have heard about it. A lot.<\/p>\n<p>But for anyone that has been a little off-grid these past 6 months, GDPR is essentially about revamping data protection laws in Europe.<\/p>\n<p>Although plans were originally announced back in April 2016, ICO published their <a href=\"https:\/\/ico.org.uk\/media\/for-organisations\/guide-to-the-general-data-protection-regulation-gdpr\/consent-1-0.pdf\" target=\"_blank\" rel=\"noopener\">final guidance<\/a> on Consent under GDPR on 10th May 2018. The new rules affect all businesses, from Facebook to your village florist.<\/p>\n<p>New privacy policies will be needed for websites and apps. In addition to requests to accept documents you\u2019ll never get a chance to read, \u2018repermissioning&#8217; emails are also landing in consumer inbox\u2019s in their droves.<\/p>\n<p>Most of those emails are probably unnecessary.<\/p>\n<p>It is a myth to think you need to get NEW permission from your customers to comply with GDPR.<\/p>\n<p>This important guy even said so in <a href=\"https:\/\/iconewsblog.org.uk\/2018\/05\/09\/raising-the-bar-consent-under-the-gdpr\/#more-3308\" target=\"_blank\" rel=\"noopener\">his blog post<\/a>.<\/p>\n<h1>Permission isn\u2019t a new thing<\/h1>\n<p>In fact, businesses have needed your consent to send marketing messages (and provide a way to opt out) since 2003!<\/p>\n<p>So if they haven\u2019t, then they may have been in breach of PECR rules for quite some time!<\/p>\n<p>And certainly the last thing you should be doing is emailing people (who haven\u2019t given you permission to email them) to ask them whether or not they mind you emailing them.<\/p>\n<p>A point proven last year when <a href=\"https:\/\/ico.org.uk\/about-the-ico\/news-and-events\/news-and-blogs\/2017\/03\/ico-warns-uk-firms-to-respect-customers-data-wishes-as-it-fines-flybe-and-honda\/\" target=\"_blank\" rel=\"noopener\">ICO fined Flybe and Honda<\/a> for that exact boo-boo.<\/p>\n<p>However if you do have a database full of soft opt-ins under PECR and you\u2019d like to turn a few of them into explicit consent under GDPR then maybe a \u2018let\u2019s be friends\u2019 email isn\u2019t such a bad idea.<\/p>\n<p>In fact, here\u2019s one we made earlier &gt; Did they make the first move?<\/p>\n<p>If you use email marketing, one option could be to look at segmenting your audience based on their responses and activity.<\/p>\n<p>Who\u2019s opened your emails? Who\u2019s clicked? You&#8217;ll need to tell people what you\u2019re going to do with their data.<\/p>\n<h2>SSL<\/h2>\n<p>Do you have an SSL certificate? Keeping user data secure is\u00a0 no-brainer.<\/p>\n<h2>Opt-ins<\/h2>\n<p>Do you ask for explicit opt in (no pre-ticked boxes or any other type of default consent).<\/p>\n<h2>Evidence<\/h2>\n<p>Do you record when they gave you permission? You need to log exactly what they were shown when they opted in.<\/p>\n<h2>Opt-outs<\/h2>\n<p>Do you make it easy for them to opt out?
